MONDAY, JULY 3, 2017

Chair Peter Garon called the regular meeting to order at 7 p.m.

  1. Pubic Hearing – James O’Brien (owner), Tracy Fisher (applicant), Ditwhitt’s Snack Shack, 109 Panton Road, Site Plan Review, Conditional Use Review

Peter Garon read the public hearing notice and swore in Tracy Fisher, Jerry Fisher, and James O’Brien. Zoning Administrator Hawley reported he had assisted the applicant in preparing a site plan. The site plan showed the location of the towable building that contains food preparation equipment. The site plan showed nine parking spaces in front of the existing building and where picnic tables are located. Tracy explained that the garage is not available for use of the bathroom and thus needed to locate a port-o-let to obtain a State permit. Members asked about the current use of the garage and owner James O’Brien said the building once housed fuel oil trucks associated with LeBeau & O’Brien Oil Company and is now just used as a storage garage. Members assumed that the proposed business was seasonal and asked the applicant to specify the season and the hours the business would operate. Tracy Fisher said the food service would operate from May 1 to October 31 and would be open to the public seven days a week; 11 a.m. to 8 p.m. Monday-Friday and noon – 8 p.m. on Saturday and Sunday. The site plan did not reflect any outdoor flood lighting and Tracey confirmed that no lighting would be installed. She said there is a trash container for customers and a dumpster located behind the garage. She said that at most there would three employees associated with the business. Peter Garon asked if there were any more questions and whether anyone on the Board felt this matter needed to be discussed in deliberative session. Steve Rapoport said that a deliberation session should be held. Peter Garon treated Steve’s comment as a motion to close the public hearing and discuss the application in deliberative session. The motion was seconded by Tim Cook with all voting favor.

Deliberative Session – James O’Brien (owner), Tracy Fisher (applicant), Ditwhitt’s Snack Shack, 109 Panton Road, Site Plan Review, Conditional Use Review

The Development Review Board held a deliberative session but took no action. The Board will continue deliberating on August 7, 2017.

2.  Pending Decision – Scott Hardy, 184/186 Green Street, The Fisher Farm, Planned Unit Development, Subdivision, Accessory Structure, Site Plan Review and Conditional Use Review

The Development Review Board reconvened and continued its deliberative session that was held on June 5, 2017. The Development Review Board finalized the content of a decision to deny the application by Scott Hardy. Jason Farrell moved to deny the application based on the findings set forth in the decision and authorize Chair Peter Garon to sign the decision on behalf of the Development Review Board. The motion was seconded by Steve Rapoport with all voting in favor of denying the application.
